This appendix exists because of a statement by Tony D'Aloisio (see the first entry) in the table.
It is true Tony D'Aloisio was only ASIC Chairman for a short time before he made his statement. However, he has now been ASIC Chairman for a sufficient period to effect major changes. The table contents below suggest any progress in improving ASIC performance has been in the negative direction.
The table is a collection of press items extracted from the Events by Date database.
In the table contains only entries overtly displaying a lack of performance on the part of ASIC. There were no major articles in praise of ASIC performance. A quick browse through the table indicates the true state of regulation in Australia: appalling!
| 31_05_2007_Crikey | Michel Pascoe article, headed with STAND BACK! ASIC GRABS THE PIN ONA $34 BILLION INVESTMENT GRENADE This excellent article risesimportant questions. How did a delaaredd $8 billion concern suddnely become $34 Billion, Further, asked why it had taken three collapses for the commision to get serious about Westpoint style schemes, Mr D'Aloisio responded, "The simple answer is I wasn't there". |
| 02_07_2007_TheAustralia | ASIC star linked to risky business - Former Australian Securities and Investments Commission Queensland regional commissioner Barrie Adams - who received the ASIC medal as recognition for his work to protect consumers against illegal fundraising schemes -- teamed up with property spruiker Les Freeman to raise up to $50 million for First Capital Securities in January 2005 |
| 04_07_2007_TheAustralian | Labor renews call for ASIC probe in wake of Bridgecorp crash, and Reform investment risk warnings: |
| 04_12_2007 | ASIC charged Karen Carey (Norm Carey's sister) with not providing the reports they demanded. Karen Carey's claimed she had no way of providing the reports as ASIC had held the books of the company for two years, and ASIC had not supplied her with copies of the information that would allow her to do so. ASIC charged Karen Carey. The matter went to Court on 04/12/2007, where ASIC withdrew their case hearing, before proceedings commenced. ASIC refused to answer any questions of why they had done so . I'm awaiting ananswer from Tony D'Aloisi on on this matter. but in this case it is difficult to see any other reason than to hide another monumental mess of its own making. I intend to write to Tony D'Alosio as to why no reason was given for the withdrawal of the case, and to request how much public money was wasted on the exercise. However, it is not only the loss of money that is troubling. When there is so much to do in cleaning up the problems in the marketplace, caused by ASIC's woeful past performance, the wastage of valuable resources borders on the criminal. |

| 08_12_2007_TheAustralian_2 | BANGARU TO BE EXTRADITED FROM THE US WITHIN WEEKS. Two points of of note in this story. ASIC negotiated with Bangaru - something they would not have had to do if they had taken action to stop him leaving Australia. The second point is we have another liquidation finding ASIC "difficult to deal with". |
| 2007_12_12_SMH | Reports the head of the failed Fincorp organisation admitting Fincorp was a high risk company promoted as a low risk while guaranteeing top rates of return. GIVEN ASIC ALLOWED FINCORP TO CONTINUE TRADING, WHICH HAD PULLED UP FINCORP ON SEVERAL PRIOR OCCASIONS FOR FAULTY PROSPECTUSES) AFTER IT HAD FOUND IT ISSUED A DELIBERATELY FALSE AND MISLEADING PROSPECTUS, SPEAKS VOLUMES ABOUT THE ABILITY OF THE REGULATOR TO CARRY OUT ITS ASSIGNED DUTIES. |
| 2007_12_12_MacAulay_DAloisio | I write to Tony D'Alosio on the Karen Carey Matter. Although Jan Redfern sends a reply, it does not nswer the questions I asked. I am still waitiong for a full reply. |
| 04_01_2008_TheAustralian | The accelerating rise of class actions is proof the current regulatory (and/or) its administration are an abject failure. |
| 07-01-2008_Herald Sun | GABRIEL NEIL PENNICOT FACES LIFE SAVINGS FRAUD CHARGES Another case in which ASIC couldn't find a fugitive, but investors could - and did. |
| 2008 | The story of Gabrial Pennicott [] is another case in which ASIC received warnings in 2002, but took no action until after Pennicott fled the country in 2005. It is very difficult to see how ASIC, which the Howard Government created with an aim of the protection of financial consumers, made any attempt to protect investors.
By now, ASIC's failure to protect financial consumers is an expectation. |
| 08-01-2008_theAge | reports the banning of a Brighton Hall AFSL holder who put clients into Westpoint between 2001 and 2003. Even after the death of Westpoint, it took the regulator two years to get around to banning the Westpoint adviser. That was two years extra to fleece unsuspecting clients. The time lapse says much about ASIC's current knowledge of those to whom itissues AFSL'S. The above ALSO ILLUSTRATES ASIC'S ATTITUDE OF SITTING ON ITS BACKSIDE WAITING FOR SOMETHING TO HAPPEN. IT IS NOT AN EFFICIENT METHOD OF CONSUMER PROTECTION |
| 24_01_2008_AFR | CAREY CLAIMS EVIDENCE WAS FALSE I find it strange that Norm Carey has consistently called for a Royal Commission involving ASIC behaviour. I have consistently called for a Royal Commission involving ASIC performance. I don't think we would present the same evidence, but does that make me Carey's fellow traveller? |
| 31_01_2008_SMH | An extract from it reads: 'But Justice Robert French rejected ASIC's application to extend the April 2006 restrictions in the Perth court on Thursday, saying it was "characterised by generality and uncertainty" about the precise state of investigations into Westpoint."In my opinion ASIC has failed to make a case." Justice French is not the only one confused about where ASIC are up to in their investigation into Westpoint. |
| 29_02_2008_TheMayneReport | Gives the number of people jailed by ASIC action over the years. The low number gives an indication of ASIC's seriousness in bringing miscreants to account. |
| 01_03_2008_TheAustralian | ASIC WARNED ABOUT DONOVAN. After Denise Brailey advised them about Westpoint and they ignored her, she should have recognised that ASIC's modus operandi is to sit and sleep until someone wakes it and informs it a disaster has occurred. ASIC will will then shout to the heavens about stupid investors, greedy planners (whit it controls), auditors, and anyone one else it can blame. It refuses to understand the true meaning of investor protection, and it is responsible for the losses of those the Liberal Government created it to protect invesors. |
| 27_03_2008_AFR_1 | ASIC REJECTS NOTIONS OF REGULARITY INACTION It's been ASIC's favourite song since 1999. |

| 03_04_2008_TheAustralian | ASIC, ASX ASLEEP AT THE WHEEL . The Never Ending Story. |
| 04-04-2008 | ASIC Media Release 08-67 refers to ASIC's discontinuation of legal action against Henry Kay. A search of the ASIC website using the key of Henry Kaye indicates just how much effort went into prosecuting Kaye. However, despite Jeff Lucy's proclamation they would keep at it until a court found him guilty, there has been no result for the spending of vast sims of public money, and the wastage of valuable resource in the form of a great many hours of ASIC's time. |
| 06_04_2008_TheAustralian | MONTY PYTHON GIVES OPES INVESTORS A LIFE LESSON Monty Python was humorous - not a tragedy involving appalling regulation. |

| 31-05_2008 SMH | reports ASX was told about the Opes fraud, but they did nothing. ASIC and the ASX were warned about Opes in February. True to its usual performance, ASIC stood and watched the disaster develop from from afar. In terms of the the ANZ's performance, Beltar of 01-06-2008 gets it right.
