On 16_12_2008 Tony D'Aloisio wrote to Westpoint investors offering them personalised information via an ASIC database. It did not give examples of possible information, and it explicitly stated the supplied information could not be guaranteed. For this privilege, ASIC demand the investor indemnify ASIC for any damages arising out of the use of this information!
On 04_01_2009 I wrote to Helen McNally on this matter and received her reply on 09_01_2009.
Dissatisfied with her reply I wrote to her again on 15_01_2009.
In one sense, the above exchanges are relatively unimportant. However, they illustrate ASIC's inability to carry out even the simplest of tasks.
On 16_01_2009 I wrote to Helen McNally requesting answers to questions showing ASIC should be responsible for Westpoint investor losses.
Ms McNally replied to my emails of 15_01_2009 and 16_01_2009 in the same email on 23_01_2009. It failed to answer any question raised in either email.
Finding her email of 23_01_2009 more than unsatisfactory I wrote to her again on 02/02/2009.
Ms McNally's reply email of 12_02_2009 demonstrates ASIC's lack of accountability for its own shortcomings.
ASIC, regulator, should set the standard for business behaviour. Ms McNally's blatant avoidance of answering my simple and straightforward questions should alarm every Australian.
